How Much Is Your Personal Injury Case Worth?

Ask A Personal Injury Law Professor

Updated September 12, 2023

In this video, our founder, Joseph Campisi, who is a Professor of Insurance Law at Osgoode Hall in Toronto explains in layman terms where to start and what to expect in trying to determine the value of your case.

Calculating how much compensation you're entitled to when you're a victim of an accident is complicated and you will definitely need professional support. Insurance companies use a number of factors to value a case. These include: your age, amount of vehicular damage, whether you were hospitalized, whether you sustained fractures and your loss of income.

At Campisi LLP, we're here to help.  If you have an Ontario Personal Injury Case, even if it’s older, we’d like to discuss it with you to see if and how we can help.  Complete the “Contact Us Now” form to the right, or give us a call.  We can set up a meeting to discuss without any obligation.

How much is a case worth?

As a lot goes into evaluating a case, these are some of the factors that should be taken into consideration.

How has the accident affected your capacity to earn money?

We look at earnings over your lifetime had the accident not taken place, and compare this to your current income as a result of the accident. This is very complicated to calculate, and we hire psycho-vocational assessors, physicians, economists and labour market experts to quantify your economic loss.

Future Cost of Care

What will your future treatment, medications, assistance with household chores, and personal care tasks cost? This is again difficult to assess, and lawyers rely on experts after injuries have plateaued. We'll request reports from treating physicians and ask a certified future cost of care expert to determine what your future needs are and how much they will cost.

The insurance claim process can be very complex. The value of a claim takes time to crystallize, and evidence has to be gathered by both sides.
