On October 3rd, 2021, CanLII (the Canadian Legal Information Institute) published the following article in their CanLII Connects Commentaries:

The Misguided Sacralization of Civil Juries - a Response to Douglas Treilhard's Comment on Louis v. Poitras.

This article was written by Campisi's own Nathan Tischler, an active, passionate advocate for the elimination of civil jury trials in Ontario.

Nathan describes delays and backlogs in the Ontario civil justice system, which have only been exacerbated by the COVID-19 public health crisis, but also points out that the underlying system was already ripe for operational review to address inefficiencies and opportunities to improve. He cites various cases in response to the opposing point of view offered by Douglas Treilhard, a lawyer with an insurance defense firm from Ottawa.

Noting that "the right to a jury trial has never been absolute for civil litigants", and that one of the key principles of common law is that it should "evolve incrementally over time", Nathan puts forth a compelling argument that Ontario's civil system must adapt in order to serve us better in contemporary times. 

 "If our justice system cannot bend to practical contemporary realities, it will break."
